Waiver

In consideration of being allowed to use the facilities and services of Plum Trees Barks provided by AW & D Kennerley and Son, Fields Farm Shoot and any of the Partners involved (“the Business”), the undersigned acknowledges, appreciates and agrees to the following:

  1. Assumption of Risk

I and anyone I bring to Plum Tree Barks under my booking understand that use of Plum Tree Barks involves potential risks including but not limited to:

  • Injury to myself, dog(s), or others
  • Property damage, loss or theft
  • Incidents involving other dogs or users
  • Incidents involving farm machinery and/or livestock

I voluntarily assume all risks associated with the use of Plum Tree Barks, including the risk of any accident, injury, damage or theft that may arise from my own actions, the action of the dogs under my booking, or the actions of others.

 

  1. Waiver of Liability

I and anyone I bring to Plum Tree Barks hereby release, discharge and hold harmless the business, it’s owners, partners, employees and volunteers from any and all claims, liabilities, damages, thefts or causes of action arising out of or related to my use of Plum Tree Barks, including but not limited to:

  • Personal injury, illness or death.
  • Property damage, loss or theft.
  • Injuries, illness or death of dog.
  • Injuries caused by other users or their dogs.

 

  1. Indemnification

I and anyone I bring to Plum Tree Barks agree to indemnify the business harmless from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including lawyer’s fees, brought as a result of my use of Plum Tree Barks and to reimburse the business for any such expenses incurred.

 

  1. Supervision and Responsibility

I and anyone I bring to Plum Tree Barks acknowledge that we are solely responsible for:

  • Supervising my/our dog(s) at all times whilst at Plum Tree Barks.
  • Ensuring my/our dog(s) are well behaved and do not pose a threat to other dogs or users.
  • Cleaning up after my/our dog(s) and properly disposing of waste.
  • Ensuring no harsh handling of dogs.

 

  1. Health and Behaviour

I certify that my and any one else’s dog(s) that visit Plum Tree Barks are in good health, free from contagious diseases and are up to date with all vaccinations including Kennel Cough. I acknowledge that the business reserves the right to refuse entry to any dog that does not meet these health requirements or displays aggressive behaviour.

 

  1. Compliance with Rules

I and anyone I bring to Plum Tree Barks agree to comply with all the rules and regulations set out in the Terms and Conditions set forth by the business for use of Plum Tree Barks. I and anyone I bring to Plum Tree Barks understand that failure to comply with these rules may result in my being asked to leave Plum Tree Barks and forfeiture of any fees paid.

 

  1. Photographic and Video Release

I and anyone I bring to Plum Tree Barks consent to the use of photographs or video recordings taken during my/our use of Plum Tree Barks for promotional or commercial purposes without compensation. This includes use on social media platforms and on the website.

 

  1. Governing Law

This waiver is governed by the laws of the United Kingdom and any disputes arising from the use of Plum Tree Barks will be subject to the jurisdiction of the courts of the United Kingdom.

 

  1. Entire Agreement

This waiver constitutes the entire agreement between myself and anyone I bring to Plum Tree Barks and the business regarding the use of Plum Tree Barks. Any modifications to this waiver must be in writing and signed by all parties.

I HAVE READ THIS WAIVER AND THE TERMS AND CONDITIONS FULLY, UNDERSTAND ITS TERMS AND SIGN IT FREELY AND VOLUNTARILTY WITHOUT ANY INDUCEMENT.
