Terms and Conditions for Plum Tree Barks

  1. Introduction

These Terms and Conditions (“Terms”) govern the use of Plum Tree Barks provided by Plum Tree Barks, AW & D Kennerley and Son, Fields Farm Shoot and any of their partners (“The businesses”). By accessing and using Plum Tree Barks, you (“the user”) agree to comply with these Terms. If you do not agree to these Terms, you must not use Plum Tree Barks.

 

  1. User Responsibilities
  • Supervision: Users must supervise their dogs at all times while in Plum Tree Barks. All dogs must be kept on lead until in the enclosed fenced field at Plum Tree Barks and all the gates are shut. All dogs in the carpark must be kept secure on a lead. Users must not enter Plum Tree Barks until previous user of Plum Tree Barks has safely left the premises. The businesses are not responsible for any incidents or accidents that occur within the premises of either Plum Tree Barks or Plum Tree Park Farm.
  • Behaviour: Users are responsible for ensuring their dogs behave appropriately and do not pose a threat to other dogs or people. Any aggressive dogs or behaviour that is deemed inappropriate is not tolerated and you may be asked to leave Plum Tree Barks and denied any further bookings.
  • Cleanliness: Users must clean up after their dogs and themselves. Dog and Human Waste/Litter must be disposed of either in the designated waste areas or by taking waste home.
  • Health: Dogs must be in good health, free from illness and/or contagious diseases. Please do not bring a dog to Plum Tree Barks that is not well. All dogs must be up to date with vaccinations, including Kennel Cough.
  • Prong collars, choke chains and electronic handling devices are not permitted. Harsh handling of dogs is not permitted.
  • Equipment and premises: All equipment on the premises of Plum Tree Barks is used at your own risk. The Businesses will not be help responsible or liable for any loss or injury caused as a result of uneven, sloping ground, wildlife burrows, or when using the enrichment equipment.
  • Children: Children are welcome at Plum Tree Barks but must be always supervised by an adult. The Businesses do not take any responsibility for or liability for accident or injury to minors. Children must not play on the enrichment equipment, climb the fences or benches.
  • Livestock and Machinery: Plum Tree Barks is located on a working farm. It is the users responsibility to ensure that livestock and machines are only observed. Livestock must not be petted or fed by the user or their guest (s). The user or their guest (s) must not allow their dog (s) to enter the fields surrounding Plum Tree Barks at risk to animal welfare. Any users or their guest(s) seen to be breeching this term will have their admittance to Plum Tree Barks permanently revoked.
  •  The user and their guest(s) must be careful of machinery using the drive upon exiting Plum Tree Barks. The user and their guest(s) must ensure safe passing of machinery.
  • Water: Plum Tree Barks has a mains water bath on site. This water can be used as Drinking water for the users dog(s) and the bath used to wash any dog(s). Users are encouraged to use this water in the best interests of their dog(s) health, particularly in hotter weather.

 

  1. Booking and Fees
  • Booking: Use of Plum Tree Barks must be booked in advance via our website and online system or by contacting Plum Tree Barks directly. Plum Tree Barks will only admit the dog (s), the Host and Guest (s)who have been named at booking. Guests of the Host must be made aware by the Host of the terms and conditions. Guests must accept responsibility for their dog (s) safety while using Plum Tree Barks.
  • Any breech of booking conditions will lead to permanent loss of use of Plum Tree Barks.
    • Fees: Fees for using Plum Tree Barks are as specified at the time of booking. All fees must be paid in full before accessing Plum Tree Barks.
    • Cancellation: Bookings for Plum Tree Barks are non-refundable if cancelled or not attended.
    1. Liability

    The Businesses hold liability insurance, however, the businesses will not be held responsible for any user, guest(s) or dog(s) during hire of Plum Tree Barks.

    • Personal injury and Property Damage: The businesses are not liable for any personal injury, accident, property damage or theft that occurs in or around the premises of Plum Tree Barks or Plum Tree Park Farm. Users enter and use Plum Tree Barks at their own risk.
    • Dog Injury: The businesses not responsible for any injuries or illnesses sustained by the dog (s) while in Plum Tree Barks premises or the premises of Plum Tree Park Farm. Users are advised to inspect Plum Tree Barks premises and ensure that it is safe before allowing their dogs to enter ( e.g. fence height, fencing materials, topography of Plum Tree Barks, footing and proximity to livestock). Any safety issues need to be reported to the owners of Plum Tree Barks.
    • Breakages or Damages: Any breakages or damages to Plum Tree Barks fields, fences, equipment will be paid for by the host (s).
    • Liability Waiver: All users and guests must sign a liability wavier before their attendance to Plum Tree Barks. Signing of the Liability waiver acknowledges the reading and acceptance of the Terms and Conditions and any responsibility for their dog, their dogs behaviour and any potential incidents involving themselves, their guest(s), any dog(s) and any children.
    • Third-Party Claims: Users agree to indemnify the Businesses against any claims made by third parties arising from their use of Plum Tree Barks.

       

      1. Use of Plum Tree Barks
      • Hours of operation: Plum Tree Barks is open during the hours specified on our website. Users must adhere to these hours and vacate Plum Tree Barks promptly at closing time. Sessions are either 55 minutes or 25 minutes, leaving 5 minutes to safely vacate. Should you arrive late to your booking the allocated time slot will remain the same. Any user or guest(s) found to be still using Plum Tree Barks over their allocated time slot will be charged for an extra session.
      • If your dog(s) is prone to excessive barking, please refrain from booking early morning or evening sessions to respect the more peaceful times for neighbours.
        • Maximum Occupancy: Plum Tree Barks has a maximum occupancy limit, which must be observed. The businesses reserve the right to limit access if this limit is reached. Any change to occupancy of Plum Tree Barks following booking must be notified to Plum Tree Barks owners.
        • Prohibited Items: No food, glass or hazardous materials are allowed in Plum Tree Barks.
        • Emergencies: Plum Tree Barks have the right to cancel any booking already made in the event of an emergency/ “Act of God” at Plum Tree Barks. These bookings will be refunded by Plum Tree Barks.
        1. Banned Breeds – Following recent XL Bully Legislation

        To ensure the safety and enjoyment of all users and guests, Plum Tree Barks has specific rules for breed that are often considered higher risk such as XL Bullies and other similar breeds. These rules are designed to promote responsible pet ownership and maintain a secure environment for all dogs and users and/or guests. These rules apply to any breeds that are classified as banned or restricted under local laws and regulations.

        • Identification requirement: Owners must declare the breed of dog(s) at the time of booking. Proof of breed may be required. This can include breed registration papers, letter from licensed vet or other official documentation. The owner must hold a government exemption certificate for the dog(s).
        • Supervision and Control: Owners must always ensure dog to handler one to one supervision whilst on the premises of Plum Tree Barks and Plum Tree Park Farm. The dog(s) must not be left unattended. Banned breeds must be kept on a leash/lead when entering or exiting Plum Tree Barks. Once inside, and the gates are secure, the dog(s) may be allowed off-leash/lead as long as no other dogs or users are present. Any signs of aggression, including growling, biting, snarling or aggressive posturing will result in immediate removal from the Plum Tree Barks.
        • Muzzle Requirement: Dogs of banned breeds must wear a muzzle at all times when on the premises of Plum Tree Barks even when off-leash/lead to prevent any potential accidents.
        • Socialisation: Dogs of a banned breed must not be socialised at Plum Tree Barks with unfamiliar users, guests or other dogs unless they have been previously acquainted with no aggression history.
        • Children: Children are not permitted to use of Plum Tree Barks in the presence of a banned breed.
        • Health and Vaccinations: Dogs must be up to date with all vaccinations including Kennel Cough. Dogs of banned breeds must be neutered and microchipped.
        • Liability Insurance: Owners of banned breed dogs must carry liability insurance that covers incidents or damages caused by their dog. Proof of insurance must be provided before entry to Plum Tree Barks.
        • Compliance with Local Laws: Owners must comply with all local laws and regulations regarding ownership and handling of banned breed dogs.
        • Incidents and Reporting: Any incidents involving banned breed dogs must be reported to the owners of Plum Tree Barks immediately. The businesses reserve the right to report any serious incidents to local authorities.

          Violation of any of these Terms will result in immediate termination to access to Plum Tree Barks for dog and owner. No refunds will be provided in such cases.

          1. Covid-19

          Any user of Plum Tree Barks with known Covid-19 infection must not enter Plum Tree Barks. Any user seen with a known Covid-19 infection using Plum Tree Barks will be asked to leave and no refund will be provided in such case.

          The 5 minute changeover period between bookings should be following to ensure no crossover between bookings and or users/guests.

          If you arrive early for your session you must remain in your vehicle until the previous user/guest(s) have left the parking area.

          1. Privacy
          • Data Collection: The Businesses will only collect personal information from users for booking and operational purposes, for example, for the requirement to get in contact with the user in case of extenuating circumstances or emergencies. This information is never shared with any other parties.
          • Marketing and Publication: Users and Guests of Plum Tree Barks are agreeing to the use of any material, text and images provided to us by the user or guest(s) or via social media and website page for the purpose of marketing and promotion.
          • CCTV: For security purposes, Plum Tree Barks may be monitored by CCTV. By using Plum Tree Barks, users consent to such monitoring.

             

            1. Amendments

            The Businesses reserve the right to amend these Terms at any time. Users will be notified of any significant changes, and continued use of Plum Tree Barks constitutes acceptance of the amended Terms.

             

            1. Governing Law

            These Terms are governed by the laws of the United Kingdom. Any disputes arising from the use of Plum Tree Barks will be subject to the jurisdiction of the courts of the United Kingdom.
